Text Messaging Service

Our Text Message Service allows Image Technology Resources employees to communicate with customers, clients, applicants, employees, or other individuals by text message for legitimate business and service-related purposes.

The service is intended primarily for conversational, person-to-person communications. Messages may include responses to inquiries, requested information, scheduling or coordination, service-related communications, and other communications related to your relationship with Image Technology Resources.

The Text Message Service may include SMS, MMS, or successor messaging technologies.

Consent to Receive Text Messages

By providing your mobile telephone number and opting in to receive text messages from Image Technology Resources, you consent to receive text messages from us for the purposes described above.

Your consent is not a condition of purchasing goods or services from Image Technology Resources unless expressly stated otherwise.

You represent that you are the authorized user of the mobile telephone number you provide or that you have permission from the account holder to provide the number and consent to receive text messages.

Message Frequency

The number of messages you receive will vary depending on your communications and interactions with Image Technology Resources.

This is a conversational messaging service rather than a subscription for a predetermined number of messages. You may receive an initial message confirming or providing information about the service, followed by additional messages as necessary to respond to your inquiries or provide relevant or requested business communications.

Message and Data Rates

Image Technology Resources does not charge you for messages sent or received through this service. However, your wireless carrier or other applicable provider may charge message and data rates according to your mobile service plan.

You are responsible for any such charges.

Information We Collect and How We Use It

We may collect information provided through the Text Message Service, including your mobile telephone number, name, and information contained in your text communications.

We use this information to:

• Send and respond to text messages
• Respond to inquiries and requests
• Provide requested information or services
• Coordinate communications and activities with you
• Maintain records of communications as appropriate for legitimate business purposes
• Comply with applicable laws, regulations, and legal obligations.

We collect and use only the information reasonably necessary to provide, manage, secure, and support the Text Message Service and our related business communications.

We Do Not Sell Your Information

Image Technology Resources does not sell, rent, or lease your personal information, mobile telephone number, or text messaging information to third parties for monetary or other valuable consideration.

We also do not sell or share your mobile telephone number or SMS opt-in information for third-party marketing or promotional purposes. Your SMS opt-in data and consent records will not be shared with third parties or affiliates for their own marketing or promotional purposes.

Service Providers and Limited Information Sharing

We may share information with service providers and vendors that assist us with providing the Text Message Service, including messaging platform providers, telecommunications providers, technology providers, and other vendors necessary to transmit and manage text messages.

These service providers are permitted to use information only as reasonably necessary to provide services to Image Technology Resources and are not authorized to sell your information or use your SMS information for their own independent marketing purposes.

We may also disclose information when reasonably necessary to comply with applicable law, regulation, legal process, or governmental request, or when necessary to protect our rights, property, users, employees, or others.

Data Retention

We retain text messages, mobile telephone numbers, consent records, and related information only for as long as reasonably necessary for the purposes described in these terms, including providing the Text Message Service, maintaining appropriate business records, resolving disputes, complying with legal or regulatory obligations, and protecting our rights.

When information is no longer reasonably necessary for these purposes, we may securely delete or dispose of it in accordance with our business practices and applicable law.

Privacy and Security

We take reasonable measures to protect information associated with the Text Message Service. However, no method of electronic communication or storage can be guaranteed to be completely secure.

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, disclosure, alteration, or destruction.

Information communicated through text messaging may be retained as necessary for business, legal, compliance, recordkeeping, or other legitimate purposes.

These SMS-specific terms govern the Text Message Service. They do not replace any other privacy practices that may apply to information collected or processed by Image Technology Resources through other means.

Opting Out

You may stop receiving text messages at any time by replying STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE to a text message from Image Technology Resources.

After receiving an opt-out request, we will stop sending additional messages through the applicable Text Message Service, except where a message is reasonably necessary to confirm or process your opt-out request or is otherwise permitted by applicable law.

An opt-out request will not be used as a reason to send messages from another number for the same messaging purpose. We will not use another phone number or messaging service to circumvent an opt-out request.

If you later provide separate express consent to receive messages for a different purpose, we may require you to affirmatively opt back in before sending messages for that purpose.

Appropriate Use

The Text Message Service is intended for lawful and legitimate business communications.

We will not knowingly use the service to send content that is unlawful, fraudulent, threatening, harassing, defamatory, discriminatory, obscene, pornographic, or intended to cause harm or obtain something of value through deception.

We also will not knowingly use the service to circumvent applicable age restrictions, opt-out requests, messaging requirements, or safeguards implemented by our messaging providers or telecommunications carriers.

No Guarantee of Delivery

Text messages are transmitted through telecommunications and messaging networks that we do not control. We cannot guarantee that every message will be delivered, delivered immediately, or delivered without interruption.

Message delivery may be affected by your mobile carrier, network availability, device limitations, geographic location, or other technical factors.

Your Privacy Choices and Requests

Depending on applicable law, you may have rights concerning the personal information we maintain about you, which may include the right to request access to, correction of, or deletion of certain personal information.

Changes to These Terms

We may update these SMS Terms and Conditions / Privacy Statement from time to time to reflect changes in our practices, technology, legal requirements, or the Text Message Service.

Your continued use of the Text Message Service after changes become effective constitutes acceptance of the updated terms to the extent permitted by applicable law.

General Terms

These terms constitute the agreement governing your use of the Image Technology Resources Text Message Service.

If any provision of these terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

These terms do not limit any rights or protections that you may have under applicable federal or state law.

Image Technology Resources reserves the right to suspend, modify, or discontinue the Text Message Service when reasonably necessary, including when required for technical, operational, legal, regulatory, or compliance reasons.
